The Gift of George W. Bush that Keeps on Giving.

As conservatives we knew there was going to be a lot of time between the filing of the first legal challenge to ObamaCare and the time when all of the separate court cases challenging ObamaCare would eventually be consolidated into one case which would make its way up the legal ladder and eventually be heard by the Supreme Court. We knew there would be plenty of time for someone or something to get to one of the more moderate members of the Court and persuade them to change their vote and support the Affordable Care Act. We knew that the supporters of ObamaCare only needed to peel off one moderate member of the Court for the Affordable Care Act to be upheld by the slimmest of margins, 5 to 4. We always thought the member of the Court that we had to worry about the most was Anthony Kennedy. We thought he was the weakest link in the chain and the most likely member of the Court to change sides. No one believed for a minute that John Roberts could be had, bought off, or sold at any price.

Right from the start the defenders of the President’s Health Care Bill had four definite yes votes to uphold the new law. Elena Kagan and Sonia Sotomayor were certainly going to support the President's landmark health care legislation. After all they were his two appointees to the Supreme Court. The other two liberals on the Court, Ginsburg and Breyer who were appointed by President Bill Clinton were equally as sure to vote for the sweeping new health care legislation which forces American to buy health insurance or pay a fine. Clinton tried to pass Universal Health Care during his first term in office. It was euphemistically referred to as “Hillary Care” after the First Lady and Secretary of State.



It was Hillary Clinton’s job as the First Lady to try to finagle her husband’s Health Care legislation through the Congress, but unfortunately for her she was unsuccessful. Now all that Barack Obama needs to do is get one of the more moderate members on the Court to switch sides and vote with the four hard core liberals on the Court and they win. ObamaCare will be affirmed as constitutional by the Supreme Court.

We always thought that the one Justice most likely to switch sides was Justice Kennedy. We never believed for a minute that it would be John Roberts! We just assumed that George W. Bush's choice for Chief Justice was as solid as a rock. We thought we could take his vote to the bank, but little did we know that just as some banks are untrustworthy today, so are some Supreme Court Justices. We hoped that the new Chief Justice was going to be part of the solution to the growing problem of the Federal Government, but we were mistaken.

We thought that together with Justices Scalia, Thomas, and Alito, John Roberts, and Anthony Kennedy would cast their votes to strike down the Affordable Care Act as un-constitutional. We thought they would kick this sweeping new health care law, with its individual mandates to the curb. After Justice Kennedy’s vigorous questioning during oral arguments and the doom and gloom predictions in the liberal media we thought we were home safe… ”Free at last, free at last, Thank God Almighty we were free at last or so we thought, but we were wrong.






The twenty-six States who sued the Federal Government on behalf of their residents, and 150 million Americans received the shock of our lives last Thursday morning when the majority opinion was read by Chief Justice John Roberts who sided with the four liberal members of the Court, Ginsburg, Breyer, Kagan, and Sotomayor. It took me about two full days to recover from the shock and disbelief.

When George W. Bush nominated John Roberts to the Court we were told that he was a great conservative jurist and he was going to make an outstanding Chief Justice of the United States. We were duped. Now we know the sad truth and just like the President who appointed him they both turned out to be classical liberals. We learned it the hard way after the decision on the Affordable Care Act. Instead of an outstanding conservative jurist, Chief Justice John Roberts has vastly expanded the power of the Federal Government and Congress to tax us. Now they can literally tax us to death because the Court has legitimized government intervention into private health care. According to new Chief Justice the government can literally tax us on everything and nothing. It is now perfectly acceptable for Congress to tax us on literally nothing… on our own inactivity... on our failure to do something specifically our failure to purchase health insurance. John Roberts even takes a broader and more expansive view of the Federal Government’s role in our lives than his predecessor did. He supports a more powerful central government, not a limited constitutional government with certain fixed enumerated powers. John Roberts is the gift of George W. Bush that keeps on giving, the legacy of George Bush that will last for a lifetime.
