Brown<\/h1>\n<h1 style=\"text-align: center;\">\u00a0<\/h1>\n<p>&nbsp;<\/p>\n<p>The old adage, &#8220;Better late than never&#8221;\u00a0unfortunately doesn&#8217;t apply to\u00a0a Montana man named Ryan Payne&#8230; He is one of the\u00a0defendants in the Oregon Standoff Trial who pled guilty to\u00a0charges of\u00a0preventing Federal officers from doing their job through the use of threats or intimidation.\u00a0Mr. Payne \u00a0pled\u00a0guilty under duress while being denied bail and kept in custody\u00a0for almost a year now.\u00a0Mr. Payne&#8217;s guilty plea was\u00a0offered in return for a promise to\u00a0receive concurrent sentences in Oregon and Nevada on another federal indictment he will stand trial for next month involving the Bunkerville Standoff which at the Bundy Ranch in 2014. Mr. Payne sought to withdraw his guilty plea when Federal prosecutors in Nevada failed to honor their arrangements with him. For Ryan Payne it would have been\u00a0better if\u00a0 Judge Brown had never ruled on his motion to withdraw\u00a0his guilty plea&#8230;<\/p>\n<p>Alas, nearly two months after an Oregon Jury returned NOT GUILTY verdicts\u00a0for Ammon\u00a0and\u00a0Ryan Bundy, and five other defendants in the first group to stand trial\u00a0over the occupation of the Malheur National Wildlife Refuge the same District Court Judge, Anna J. Brown who presided over those trials denied Ryan Payne&#8217;s motion today to withdraw his guilty plea after Federal prosecutors\u00a0renigged on their deal with him&#8230;<\/p>\n<p>&nbsp;<\/p>\n<p><img loading=\"lazy\" class=\"alignright size-full wp-image-9712\" src=\"https:\/\/lessgovisthebestgov.com\/blog\/wp-content\/uploads\/2016\/12\/Ryan_Payne.png\" alt=\"\" width=\"196\" height=\"257\" \/>Defending her decision not to grant Mr. Payne&#8217;s change of plea\u00a0the judge declared, &#8220;It was a typical case of <em>buyers remorse&#8221;.<\/em>\u00a0 Mr. Payne filed\u00a0his motion to change his plea to NOT GUILTY\u00a0 over\u00a0two and a half\u00a0months ago on October 13th, 2016\u00a0long before\u00a0an Oregon\u00a0jury returned not guilty verdicts\u00a0for\u00a0all seven defendants\u00a0in the first group to stand trial, but Federal prosecutors objected to\u00a0his change of plea motion even though they were the ones who reneged on the plea deal they offered him to have any sentence he received in Oregon\u00a0run concurrently with\u00a0any sentence he received in Nevada.<\/p>\n<p>&nbsp;<\/p>\n<p>As a result of the Judge&#8217;s ruling\u00a0Ryan Payne will now have to serve at least three and a half years in\u00a0Federal prison\u00a0for his participation in the\u00a0protest in Oregon in addition to whatever time he\u00a0receives in Nevada while everyone else who was\u00a0at the Malheur Wildlife Refuge\u00a0in Oregon including the leaders of the so called &#8220;occupation&#8221; wont have to serve any time in jail\u00a0in theory at least&#8230; Actually Ammon and Ryan Bundy have already been locked up without bail for almost a year now just like Payne&#8230; but that is how\u00a0our wonderful\u00a0justice system works under\u00a0America&#8217;s first Black President and\u00a0America&#8217;s\u00a0second Black Attorney General.
