A\u00a0government vendetta against the family of Nevada rancher, Cliven Bundy ran into a major roadblock in Oregon when a jury unanimously found two of his sons, Ammon and Ryan\u00a0Bundy not guilty of conspiracy and Federal firearms charges. They\u00a0were both acquitted on all thirteen counts. It wasn’t\u00a0 quite, “Free at last.\u00a0Free at last.\u00a0Thank God Almighty I am free at last”<\/em>, but at least the government\u2019s plan to incarcerate them\u00a0along with\u00a0five other defendants for up to six\u00a0years received a major\u00a0blow as a Portland, Oregon jury saw right through the government\u2019s\u00a0overreaching indictment and\u00a0straight into the\u00a0heart of the matter.<\/p>\n

There was no conspiracy, the jury\u00a0concluded… and they found no\u00a0proof that the defendants ever intended to threaten\u00a0any government employees who worked at the Refuge. There was\u00a0no evidence of\u00a0intimidation of any government employees because\u00a0there were no government employees\u00a0at the Refuge during the\u00a0whole time\u00a0that the defendants\u00a0were there.\u00a0 The jury\u00a0drew a distinction between the\u00a0defendant’s\u00a0actual intentions and the\u00a0 unintended consequences of their actions which the defendants\u00a0had no control over. The occupation of the Malheur National Wildlife Refuge began as a spontaneous response to the government\u2019s\u00a0own unlawful actions against two Oregon ranchers, Dwight and Steven Hammond\u00a0of Burns, Oregon. That is what happened, and that is exactly what the jury concluded.<\/p>\n

Ammon and Ryan Bundy<\/p><\/div>\n

Ammon and Ryan Bundy have spent the last nine months of their lives in jail\u00a0because they dared to tell the United States\u00a0government that it was wrong\u00a0to incarcerate Dwight and Steven Hammond\u00a0for\u00a0arson\u00a0under a federal anti-terrorism act.. The Bundy’s\u00a0determination has been met with\u00a0stubbornness by\u00a0federal prosecutors.\u00a0 Their\u00a0dedication and courage\u00a0has cost them dearly. It\u00a0has meant that they\u00a0will remain\u00a0jail at least until the end of their\u00a0next trial in Nevada over a previous\u00a0confrontation\u00a0that their father,\u00a0Cliven Bundy had with the BLM in\u00a02014.<\/p>\n

After the verdicts in Portland\u00a0were read, the Judge told\u00a0all seven\u00a0defendants that they were free to go\u00a0unless\u00a0Federal Marshal’s\u00a0had something\u00a0different to say about it.” At that point David Fry\u00a0was a free man after spending the last nine months of his life behind bars just in order to make it look like\u00a0this\u00a0wasn’t a government vendetta against\u00a0the\u00a0family of Cliven Bundy, but the Marshals\u00a0had other plans for Ammon and Ryan. They are the only two defendants\u00a0in the occupation trial of the Malheur National Wildlife Refuge to\u00a0still remain in federal custody more than a year later.\u00a0<\/p>\n

Marcus Mumford, the attorney for Ammon Bundy\u00a0expected that his client\u00a0was going to\u00a0be released\u00a0after the not guilty verdict. He\u00a0promised the judge that Mr. Bundy would report for trial as ordered\u00a0in Nevada. He argued with\u00a0Judge Brown that his client should be free to go. Voices\u00a0were allegedly raised and someone in the courtroom\u00a0said\u00a0that Judge Brown told Mr. Mumford to stop yelling at her.\u00a0At some point the Marshals took\u00a0control of the courtroom. They surrounded Mr. Mumford.\u00a0 When he\u00a0asked\u00a0to see their paperwork\u00a0which allowed them to\u00a0detain his client they grabbed him and attempted to restrain him.\u00a0They obviously didn’t think they needed to prove anything to Mr. Mumford. A scuffle ensued\u00a0when they\u00a0grabbed him and\u00a0at least five Federal marshals\u00a0forced him to the ground.<\/p>\n

As this scuffle went on\u00a0a table\u00a0got flipped over\u00a0and computers and papers went flying.\u00a0 The judge ordered everyone\u00a0to clear the courtroom while\u00a0Mr. Mumford\u00a0was tazed, handcuffed, and arrested. It is ironic that Mr. Mumford was arrested\u00a0and\u00a0booked for the same\u00a0crime that his client Ammon Bundy had just been acquitted of.\u00a0After\u00a0obtaining a not guilty verdict for his client, \u00a0Mr. Mumford was\u00a0jailed and released on his own recognizance on charges of impeding federal officers.<\/p>\n

The courtroom scuffle\u00a0which occurred after\u00a0the not guilty verdicts were rendered is further evidence that the courts and the executive branch of government are out of control. They don’t\u00a0obey\u00a0their\u00a0own laws more less follow the Constitution they swore to uphold\u2026 They pick and chooses what laws they will obey and what laws they will not obey..\u00a0and now\u00a0we have a government that assaults and arrests\u00a0a defense\u00a0attorney\u00a0after he\u00a0beats them in court.<\/p>\n

“I don\u2019t think such a thing has ever happened before in Federal Court where\u00a0Marshals have attacked a defense attorney,\u00a0and then tazed and arrested him”,<\/em> attorney Mike Arnold said. Mr. Arnold was the first attorney who originally represented Ammon Bundy in Oregon, but\u00a0he withdrew\u00a0a month\u00a0later. \u00a0It shows just how bitter\u00a0and hard fought this legal battle has been and just how angry the government\u00a0is\u00a0over losing.\u00a0 Loretta Lynch, Billy Williams and the Obama Un-Justice Department is\u00a0absolutely furious. The DOUJ is like a wounded animal, even more dangerous than it was before the trial began..<\/p>\n

After being booked in\u00a0county jail Mr. Mumford was released and given\u00a0a trial date in January.<\/p>\n

Meanwhile what is going to happen to the next group of defendants who occupied the Refuge who are scheduled to go on trial sometime in February? Will the charges against them be dropped now that the leaders of the so called \u201cconspiracy\u201d have all been found not guilty… or will the government file new and different charges?<\/p>\n

What about those who pled guilty to the charges in order to avoid the\u00a0possibility of long jail sentences? Will they\u00a0have to serve jail time even thought all the others were found not guilty? That would be rather unfair as their guilty pleas were obtained under duress\u00a0 and real intimidation… unlike the kind they were accused of.\u00a0Ryan Payne is one of the defendants who pled guilty, but afterwards tried to retract his guilty plea when he\u00a0realized \u00a0that\u00a0he felt\u00a0he had been misled by Federal prosecutors.\u00a0His attempt\u00a0to withdraw his guilty plea was unsuccessful.<\/p>\n

There are still a lot of unanswered questions,\u00a0but none is more important then\u00a0why Ammon and Ryan Bundy\u00a0have to remain in Federal custody until their next trial is over. The truth is that there\u00a0really is a government vendetta against the family of Cliven Bundy. Cliven and his four sons Ammon, Ryan, Mel, and David are all behind bars.<\/p>\n

The not guilty verdicts in Oregon are not just a win for the defendants. They are a rebuke of the government\u2019s heavy handed actions and tactics which they used against the\u00a0 people who occupied the Refuge as well as\u00a0against the Hammond family which inspired the occupation in the first place. It is a rebuke of the FBI, the Oregon State Police, the Department of Justice,\u00a0the Court system, and it is especially a rebuke of\u00a0federal prosecutors. The\u00a0 government has been sent a clear message of disapproval by the Oregon jury who heard the case.<\/p>\n

Federal prosecutors thought this was going to be a slam dunk case, but even with the\u00a0deck heavily stacked in their favor…\u00a0the government could still not convince the jury of a conspiracy. At the end of court proceedings every day, three federal prosecutors wheeled a large rolling file cabinet filled with notebooks\u00a0containing\u00a0evidence out of the courtroom and down the elevator to the fourth floor where their offices are located. Using all of the enormous resources of the federal government\u2026 tremendous financial and\u00a0legal resources which the largest and most powerful country on the face of the earth can muster they still could not\u00a0convince the jury\u00a0when matched against the plain and simple, honest truth that was\u00a0obvious in the courtroom testimony of Ammon Bundy and in the riveting closing arguments of his brother Ryan. All seven defendants were completely and fully exonerated on\u00a0all thirteen counts in the\u00a0federal indictment as well as on the Federal firearms charges as well.<\/p>\n

The\u00a0Department of Justice\u00a0assigned three\u00a0prosecutors to the case. They were twelve paid government informants who infiltrated the Refuge and were spying on the defendants throughout the\u00a0entire time\u00a0they were there. The prosecutors raised thousands of\u00a0objections in the courtroom during the six week long trial nearly all of which were sustained by the judge. Much of the evidence that defense attorneys wanted to present to the jury was not even allowed to be seen by the jury and numerous defense witnesses were not permitted to testify in court.<\/p>\n

The judge called the evidence and the testimony which she banned from the courtroom cumulative in nature. She said\u00a0 she didn\u2019t want to waste the jury\u2019s time with all of it, but what\u00a0might be\u00a0cumulative to one juror\u00a0might be corroborative to another.\u00a0Video evidence that\u00a0managed to escape the judge’s gavel and\u00a0 actually did make it into the trial was strictly edited right down to the\u00a0last nano-second in order to prevent the jurors from hearing too much from the\u00a0inspiring\u00a0man who is at the center of this trial… Ammon Bundy.<\/p>\n

At this point I would like to mention the names of the other five defendants\u00a0who were\u00a0found not guilty of conspiracy and not guilty of violating federal firearms statutes… They are Shawna Cox, Ken Medenbach, David Fry, Jaff Banta, and Neil Wampler.<\/p>\n

Even with the courtroom heavily stacked in their favor the government still lost the case\u2026 and they didn\u2019t just barely lose. They lost on every single count, and on every single charge.\u00a0\u00a0Their case was tossed out on its ears by\u00a0an impartial jury\u00a0which they\u00a0 picked\u00a0to act as the official arbiters of truth.\u00a0Chalk one up for justice. John Qunicy Adams, America\u2019s sixth President who was a\u00a0lawyer himself once said, \u201cThe law is an artificial human construct. It is good for nothing outside of a court of law.\u201d I was glad to see that at least it still\u00a0works inside of a court of law, because after attending this trial I really had my doubts.\u00a0Thank God for\u00a0the jury.<\/p>\n
