The Other Occupation and the Other Trial<\/strong><\/h1>\n

In case you don’t remember there has been more than one trial involving the Bundy family that grabbed the Nation’s attention. The trial going on right now in Las Vegas involves the standoff with the BLM that occurred at Bunkerville, Nevada in April of 2014. A previous trial involved the occupation of the Malheur National Wildlife Refuge near Burns, Oregon in December of 2015.\u00a0 That trial was about the occupation of the Wildlife Refuge which lasted for 41 days and resulted in one death and at least fourteen persons charged with conspiracy. Most of the defendants in that trial including Ammon and Ryan Bundy were acquitted of all charges.. There is however another trial going on which the media never talks about. That trial is going on in the minds of\u00a0Americans all around the country. It concerns the occupation of about 700 million acres of land in twelve western States by the Federal Government. This occupation has been going on for more than a century.\u00a0In some\u00a0cases it has been going on\u00a0since the end of the Civil War. The occupation of Western States has been a continuous overreach of the Federal government since the occupation of Southern States came to an end.\u00a0It now involves almost 25% of\u00a0all the land in the\u00a0entire country.<\/p>\n

The Occupation of the Malheur National Refuge Trial was\u00a0held in Federal District Court in Portland, Oregon where Ammon and Ryan Bundy and five other defendants were\u00a0prosecuted\u00a0on charges of conspiracy to impede federal officials. The other trial… the occupation of Western States trial is going on in the court of public opinion and in the minds of\u00a0countless\u00a0people\u00a0across this country and\u00a0around\u00a0the world\u00a0wherever there is internet access.\u00a0The\u00a0United States\u00a0government is on trial\u00a0in the minds of millions of people both here and abroad for its unconstitutional land use policies\u00a0in the American West, and for the way in which in which it prosecuted not only the Bundys, but two Oregon ranchers named Dwight and Stephen Hammond as well. Those two men\u00a0were tried and convicted\u00a0of arson under a federal anti terrorism\u00a0act for\u00a0implementing the standard weed management practices on their grazing land which has been used for centuries. They were sentenced to\u00a0spend five years in a federal\u00a0penitentiary in southern California, and the federal government is also on trial for the violent way in which it ended the 41 day occupation of the Malheur Wildlife Refuge\u00a0by shooting Lavoy Finicum, one of the leaders of the occupation in the back while his hands were up in the air in a sign of surrender.\u00a0 They\u00a0allowed him to die by not\u00a0providing the timely medical assistance he needed.<\/p>\n

\n The United States\u00a0government’s\u00a0unconstitutional land use policies date all the way back to 1850 when Congress\u00a0passed\u00a0the Enabling Act\u00a0which made California a State. In doing so Congress confiscated 45% of\u00a0the land in California. The same unconstitutional\u00a0appropriation of State land\u00a0occurred eleven more times over the next 100 years as eleven\u00a0more States were added to the Union beginning with Oregon in 1859 and ending with Alaska in 1959. Each time a new State entered the Union more State land was confiscated by the federal government until\u00a0it\u00a0now controls more land than all\u00a0but a handful of\u00a0countries on\u00a0planet earth. This\u00a0confiscation of State land by Congress violates\u00a0the Equal Footing Principle which dates back to the founding of our country.<\/p>\n

The Equal Footing Principle says that\u00a0all new States\u00a0are supposed to be admitted to the Union on the same basis as all of the other States.\u00a0The Federal government owns 3% of the land east of the Mississippi River Valley and 50% of the land west of the Mississippi River Valley.. There is nothing equal at all about that. The unconstitutional land use policies\u00a0put into place by Congress became even worse in 1976 when it passed the Federal Land Policy Management Act which formally abolished the Homestead Act. That overturned almost 200 years of\u00a0precedent and American\u00a0history. Meanwhile the agencies that Congress\u00a0has established to manage\u00a0all of this\u00a0confiscated State land have become exceedingly harsh and difficult to work with for all of the farmers and ranchers who live in the American West and\u00a0have grazing rights and water rights on these lands. That brings me back to the story of two ranching families… the Hammonds of Oregon and the Bundys of Nevada.<\/p>\n

In the court of public opinion the\u00a0liberal media acts as a\u00a0filter so we don’t usually hear\u00a0the whole truth. In Federal District Court a\u00a0liberal judge\u00a0 usually acts as\u00a0the filter so the jury doesn\u2019t hear all of the corroborating evidence that defense attorneys want to present. So much for “the truth… the whole truth… and nothing but the truth…”<\/em> According to Judge Anna Brown of Oregon too much of the truth\u00a0was\u00a0way\u00a0“too cumulative” for the jury to hear.\u00a0 She didn’t want\u00a0to, “waste the jury’s time”.<\/em><\/p>\n

There is a bitter irony\u00a0that hasn\u2019t escaped my attention\u2026 If\u00a0a group\u00a0occupies Wall Street the liberals in the\u00a0media will sympathize with them and embrace their cause. If\u00a0a group\u00a0occupies the waterfront across from downtown Portland they will support the\u00a0protest with\u00a0positive publicity.<\/p>\n

\u00a0If\u00a0the federal government\u00a0occupies 700 million acres of State land the liberals will defend\u00a0this land seizure under the auspices of the General Welfare Clause of the Constitution and they will\u00a0erect a monument to the American President who blazed the way for even more seizures of State land, but if\u00a0a handful of patriotic and loyal Americans attempt to\u00a0occupy a deserted Wildlife Refuge in the middle of nowhere and think they can challenge the Federal government’s\u00a0authority to\u00a0own State land\u00a0then\u00a0they\u00a0are accused of being armed militants and charged with conspiracy. The liberals will\u00a0throw them in jail without bail until their trial and they will deny\u00a0them the presumption of innocence which is even afforded to\u00a0the worst felons. What’s more… they will even shoot you in the back while\u00a0you are not looking and your hands are up in the air.<\/p>\n

Having the courage to stand up to your government and point out that it isn\u2019t following the Constitution is a heinous crime worse than murder. It is such a serious\u00a0offense that it\u00a0\u00a0requires the harshest retribution including long prison sentences, solitary confinement, torture, and even death. Welcome to the America in the 21st Century.<\/p>\n
