We\u00a0had another\u00a0candidate running who should\u00a0have rightly been\u00a0locked up\u00a0and thrown in jail for her\u00a0role\u00a0in the murders of four Americans\u00a0at Benghazi\u00a0and the sale of our domestic uranium supplies to the Russians while she was\u00a0Secretary of State. To make matters\u00a0worse she committed a crime when she hid and then deleted all of\u00a0her official government emails\u00a0from\u00a0her own\u00a0private server\u00a0which was under her\u00a0own personal\u00a0control, yet she remained the candidate of the Democrat Party for President in 2016.\u00a0<\/p>\n<p>Meanwhile we had\u00a0our first Black\u00a0President in American history\u00a0who should never have been\u00a0allowed to be President not because he wasn&#8217;t born in America but because his father wasn\u2019t\u00a0an American\u00a0citizen, but no matter. He negotiated a treaty\u00a0with our enemies who\u00a0will\u00a0still\u00a0be our enemies\u00a0even after the ink on the paper has dried.\u00a0\u00a0\u00a0You\u00a0can\u2019t make this stuff up.<\/p>\n<p>The truth speaks volumes about the level of corruption that is\u00a0going on\u00a0in Washington D.C.\u00a0 today It testifies to\u00a0the level of disrespect for the Constitution that exists in our nation&#8217;s capitol. That is why\u00a0Washington is frequently\u00a0referred to as the &#8220;<em>The Swamp on the Hill&#8221;. <\/em><\/p>\n<p><a href=\"https:\/\/lessgovisthebestgov.com\/blog\/wp-content\/uploads\/2013\/10\/Capitol-Hill-9.jpg\"><img loading=\"lazy\" class=\"alignleft size-full wp-image-3854\" src=\"https:\/\/lessgovisthebestgov.com\/blog\/wp-content\/uploads\/2013\/10\/Capitol-Hill-9.jpg\" alt=\"Capitol Hill 9\" width=\"259\" height=\"194\" \/><\/a>In February the Senate passed a Bill which was co-sponsored by\u00a0a Democrat who is\u00a0currently under indictment\u00a0on corruption charges.\u00a0His name is Robert Menendez.\u00a0A politician being investigated\u00a0for corruption isn&#8217;t unusual.\u00a0\u00a0\u00a0The Bill\u00a0was also sponsored by\u00a0Republican\u00a0Senator Bob Corker from Tennessee. This completely unnecessary legislation <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/615\/text\" target=\"_blank\" rel=\"noopener\">Senate Bill S615 The Iran Nuclear Agreement Review Act of 2015 <\/a>purports to give the Senate\u00a0a power that it already has under <a href=\"http:\/\/context.montpelier.org\/document\/175?gclid=CJSe4J3C7MQCFRaTfgodq1wA7g\" target=\"_blank\" rel=\"noopener\">Article II Section 2 of the Constitution<\/a> to\u00a0block any treaty that the President negotiates with Iran. What it really does\u00a0however is\u00a0<em><strong>give away\u00a0<\/strong><\/em>the Senate &#8216;s <strong>Power of Consent<\/strong> that it already has under the Constitution. About two months after\u00a0S615 was passed\u00a0in the Senate, the House of Representatives took up the same issue\u00a0and passed their own version of the bill, <a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/house-bill\/1191\/\" target=\"_blank\" rel=\"noopener\">HR 1191 .<\/a> The House\u00a0bill\u00a0was\u00a0then reconciled with the Senate version of the same bill and\u00a0lo and behold&#8230; the Iran Nuclear Agreement Review Act of 2015 became the law of the land. That is how\u00a0treason works.<\/p>\n<p>The Senate doesn\u2019t need to pass a bill in order to withhold their consent on\u00a0any treaty that the President tries to make. It doesn&#8217;t matter\u00a0if he calls it a treaty or not.\u00a0 He can call it a hot dog if he likes, but it is still a treaty. The Senate already has the power under the Constitution and the President and the House of Representatives have nothing\u00a0to say about it. The Power of Advice and the Power of Consent\u00a0belongs to the Senate\u00a0under Article\u00a0II Section 2 of the Constitution. The Founding Fathers enumerated that power and gave it to them. Either all of the members of Congress\u00a0have\u00a0gone completely nuts\u00a0or\u00a0we are no longer living in a constitutional republic.\u00a0 The Senate does not need to pass a bill in order to fulfill\u00a0its\u00a0obligations under the Constitution.\u00a0It just needs to\u00a0do\u00a0its job.<\/p>\n<p><a href=\"http:\/\/context.montpelier.org\/document\/175?gclid=CJSe4J3C7MQCFRaTfgodq1wA7g\" target=\"_blank\" rel=\"noopener\">In Article II Section 2 of the United States Constitution it reads, <\/a><em><strong>\u201c<\/strong>The President shall have power<\/em> <strong><em>by and with the Advice and Consent of the Senate<\/em> <\/strong><em>to make Treaties <strong>provided that two-thirds of the members present concur<\/strong>.\u201d<\/em> That is the Senate&#8217;s\u00a0authority. It is absolute. It is\u00a0final, and it is veto proof.\u00a0 It doesn&#8217;t require Congress to pass anything in order for the Senate to do its job. All\u00a0the members of the Senate have to do is\u00a0use the power given to\u00a0them under the Constitution. and do their job. They don\u2019t need to ask the President\u2019s permission in order to\u00a0prevent a bad treaty from becoming\u00a0law. They\u00a0have had that\u00a0power from the day that our Constitution was ratified.<\/p>\n<p>HR1191 is the\u00a0treasonous legislation\u00a0passed\u00a0by both Houses of\u00a0Congress which requires the President&#8217;s permission before any\u00a0treaty negotiated with Iran can be tossed into the legislative trash\u00a0can where it rightly belongs. That is not the way\u00a0our Constitution works.\u00a0This\u00a0Bill\u00a0passed by both Houses of Congress and signed by the President limits the Senate&#8217;s\u00a0Advice and Consent Powers under the Constitution\u00a0to\u00a0merely offering\u00a0their non binding advice on\u00a0the Iran Nuclear Weapons Agreement. It allows\u00a0the\u00a0President to\u00a0exercise a veto over\u00a0any\u00a0advice that the Senate gives him and any consent that they deny him\u00a0on this treaty. The President does not\u00a0have\u00a0unlimited power to make treaties under\u00a0the Constitution.\u00a0 The Senate\u00a0has the final\u00a0authority on any and all treaties. They have the Power of Consent as well as\u00a0an\u00a0opportunity to offer their advice to the President, but\u00a0HR 1191\u00a0gives\u00a0the President all of the power to\u00a0make this nuclear treaty with Iran\u00a0a reality without the\u00a0necessary two thirds of the members of the Senate\u00a0concurring.\u00a0<\/p>\n<p>It\u00a0appears like all the President needs under HR 1191 is a simple majority\u00a0vote or just 51 members\u00a0of the Senate voting in favor of it and it becomes law. Now if that isn&#8217;t bad enough in reality\u00a0the Iran Treaty\u00a0doesn&#8217;t\u00a0even need\u00a0a single\u00a0Senate Vote to become the law of the land. According to HR 1191 Barack Obama\u00a0can\u00a0veto any action\u00a0the Senate takes on this treaty. If it doesn&#8217;t even get\u00a0one vote in favor of it all the President has to do is whip out his veto pen and veto the Senate&#8217;s\u00a0decision and the treaty becomes law anyway. Now\u00a0the Senate\u00a0has to muster 67 votes to override a Presidential veto.\u00a0If\u00a0he didn&#8217;t have the necessary 67 votes to pass the Treaty the way it is supposed to become law under the Constitution how\u00a0will they find 67 votes to override a Presidential veto and strike it from the law? HR 1191 undermines one of the\u00a0critical checks\u00a0and balances\u00a0in the Constitution. For all intents and purposes it renders Article II Section 2 of the Constitution\u00a0null and void and gives President Obama unlimited power to make this treaty.<\/p>\n<p>I have never seen the Iran Nuclear Agreement Review Act of 2015 properly explained anywhere\u00a0 so let me take\u00a0the\u00a0time to tell you\u00a0how it works so you know just how badly the Constitution is being violated by traitors in both political parties.\u00a0 The way\u00a0that treaties are supposed to become law under\u00a0our Constitution is that the Senate votes and two thirds of the members present must vote in favor of\u00a0the treaty\u00a0in order for it to become\u00a0law&#8230;\u00a0 There are 100 members of the Senates so if they are all present on the day that the vote is taken then 67 Senators must vote in favor of the treaty in order for it to become law.<\/p>\n<p>What the Iran Nuclear Agreement Review Act does is reduce the number of votes actually required to pass the treaty to only 51\u00a0votes which\u00a0means that only\u00a0a simple majority of Senators present\u00a0 must concur in order for it to become a law instead of the actual two thirds of the Senate required. That is the first way that the Iran Nuclear Agreement Review Act of 2015 violates the Constitution. If the President can&#8217;t even get a simply majority to vote in favor of\u00a0his treaty with Iran than the President can veto the Senate&#8217;s decision. That is something that he cannot do under the Constitution. Then it\u00a0 takes a two thirds majority vote of both Houses of Congress in order to overturn a Presidential veto. Under the Constitution it\u00a0takes a two thirds vote of\u00a0just the Senate to pass a treaty. Now as a result of HR 1191 it takes a two thirds vote of both Houses of Congress to overturn\u00a0a Presidential veto\u00a0and prevent the treaty with Iran from remaining the law. If the required two thirds votes were not there originally to begin with in order to\u00a0pass the treaty then how will they come up with the two thirds votes to overturn a Presidential veto? The answer is they can&#8217;t\u00a0and they wont come up with those votes\u00a0 so the treaty becomes\u00a0law\u00a0in a manner outside of \u00a0the normal Constitutional process.<\/p>\n<p>If the Senate wants to abdicate its Constitutional authority then\u00a0it has to\u00a0pass a Constitutional Amendment. It must be approved by a two-thirds vote of both Houses of Congress.\u00a0Then it must be approved by three-fourths of all of the States before it\u00a0can become the law of the land. There are no shortcuts to changing the Constitution.\u00a0What the Congress has done in Washington D.C. by passing HR 1191 is a crime. Members of Congress cannot change the Constitution\u00a0merely by pushing\u00a0some Senate Bill through\u00a0a committee and then having the having the House of Representatives pass it by a simple majority vote. It doesn&#8217;t work like that.<\/p>\n<p><a href=\"https:\/\/www.congress.gov\/bill\/114th-congress\/senate-bill\/615\/cosponsors\" target=\"_blank\" rel=\"noopener\">The Iran Nuclear Agreement Review Act of 2015\u00a0\u00a0<\/a> first proposed by Senator Menendez\u00a0of New Jersey\u00a0falls under the category of high crimes and misdemeanors.\u00a0Everyone who voted for it should be tried for treason.\u00a0<a href=\"http:\/\/www.senate.gov\/legislative\/LIS\/roll_call_lists\/roll_call_vote_cfm.cfm?congress=114&amp;session=1&amp;vote=00174\" target=\"_blank\" rel=\"noopener\">Supporters of the Bill include some surprising names\u00a0in the Senate<\/a> and <a href=\"https:\/\/www.govtrack.us\/congress\/votes\/114-2015\/h226\" target=\"_blank\" rel=\"noopener\">in the House <\/a>who should know better than this like Marco Rubio, Ted Cruz, Rand Paul, and\u00a0Senator Mike Lee.\u00a0 Ninety-eight members of the United States Senate voted for this Bill which\u00a0strips the Senate of its Advise and Consent Powers\u00a0having to do with\u00a0the Iran Treaty and hands the President a veto\u00a0which he does not have under the Constitution. Only one member of the Senate voted no on the Iran Nuclear Agreement Review Act&#8230;That was Senator Cotton of Arkansas, and one Senator abstained from voting altogether. That was Democrat Senator Barbara Boxer from California who happens to be Jewish. Every single other\u00a0member of the United States Senate\u00a0voted to usurp the Constitution including Marco Rubio, Ted Cruz, Rand Paul, and Mike Lee. The Senate&#8217;s Power of Consent over treaties is\u00a0absolutely veto proof and these Senators are\u00a0giving it up for a much lessor role in this matter\u00a0which is not veto proof. They are either effectively\u00a0ignorant of the Constitution or else we are no longer living in a constitutional republic&#8230;\u00a0\u00a0<\/p>\n<p><a href=\"https:\/\/www.govtrack.us\/congress\/votes\/114-2015\/h226\" target=\"_blank\" rel=\"noopener\">The vote in the House of Representatives on the House Version of the Iran Nuclear Agreement Review Act <\/a>was\u00a0not much better&#8230;\u00a0 It was 400 to 25 with 7 abstentions. Only 19 Republicans and 6 Democrats voted against it. Among\u00a0the Republicans who voted\u00a0nay were Louie Ghomert from Texas, Tom McClintock from California,\u00a0Tim Huelskamp from Kansas, and Dave Brat from\u00a0Virginia.\u00a0Either the majority of Congressmen and Senators are effectively ignorant of the Constitution or else we are living under some form of\u00a0martial law.\u00a0Members of Congress\u00a0have sworn to uphold the Constitution but in reality they are\u00a0actually\u00a0undermining and usurping it.\u00a0 Why would\u00a0Senators give up their\u00a0absolute constitutional authority over a\u00a0treaty\u00a0and\u00a0exchange it\u00a0for a\u00a0more limited\u00a0role of merely offering\u00a0their non binding advice\u00a0to\u00a0the President which he can choose to ignore\u00a0with\u00a0a veto?\u00a0<\/p>\n<p>I don\u2019t know what the hell\u00a0our members of Congress actually think they are doing in Washington D.C., but we didn&#8217;t send them there to surrender to the President or to the Ayatollah of Iran. The President\u00a0cannot veto a legislative power that has\u00a0been\u00a0delegated to the Senate by the Constitution. The Senate has the sole authority to\u00a0stop any\u00a0treaty that the President makes with Iran. They don&#8217;t need to get his permission in order to do that and they don&#8217;t need to\u00a0give him the opportunity to veto\u00a0any decision they make.
