We knew as conservatives that there was going to be a lot of time between the filing of the first legal challenge to Obama Care, and the time when all of the separate court cases would eventually be consolidated into one, and that one case would eventually be heard by the United States Supreme Court. We knew that there would be plenty of time to get to one of the more moderate members of the Court and persuade them to change their mind and vote along with the liberals to uphold the Affordable Care Act. We knew all along that the defenders of Obama Care only needed to peel off one of the more moderate Justices, and the Affordable Care Act would be upheld by the slimmest of margins, 5 to 4 by the highest court in the land.  We always thought that the vote we had to worry about, the one that might flip was Anthony Kennedy’s vote, that he was the weakest link in the conservative chain, the most likely member of the Court to switch sides. No one ever believed for a minute that John Roberts could be had, or bought off at any price!

The supporters of the President’s Health Care Bill had four definite yes votes right from the start to uphold the new law. That was certain. The two Obama appointees to the Court, Elena Kagan and Sonia Sotomayor were a given! The other two liberals on the Court, Ginsburg and Breyer were equally as sure to vote to uphold the sweeping new law since Justice Ginsburg was appointed by Bill Clinton in 1993 and Justice Stephen Breyer was nominated by Bill Clinton in 1994.



President Bill Clinton tried to pass Universal Health Care Legislation during his first term in office. It was euphemistically referred to as “Hillary Care” after the current Secretary of State. It was Hillary Clinton’s job as the First Lady, to try to finagle her husband’s Health Care legislation through Congress, but fortunately for us she was unsuccessful then. The progressives knew that all they needed to do this time under President Obama was to get one of the more moderate members of the Supreme Court to vote with the four liberals to uphold the law, and they would win.

We always thought the one Justice most likely to change sides and join with the liberals was Justice Kennedy. We never believed in our wildest dreams that it would be John Roberts! We assumed that Justices Scalia, Thomas, Alito, and Roberts were all as solid as a rock, or three rocks. We figured they were all solid conservative votes that we could take to the bank. But just like some banks are untrustworthy today, so are some Supreme Court Justices totally unworthy of our trust. Part of the bedrock of our national hope to restore some semblance of limited constitutional government back to Washington D.C., that’s what we hoped Chief Justice John Roberts was. But boy oh boy, were we ever mistaken!

We thought that Justices Scalia, Thomas, Alito, Roberts, and Kennedy would all cast their votes to strike down the Affordable Care Act as an un-constitutional abuse of power in its entirety, to kick it to the curb, this sweeping new health care law, with its universal mandate. We thought we only had to worry about a single Justice on the Court, Kennedy. But after Justice Kennedy’s vigorous questioning in oral arguments and the doom and gloom predictions of the liberal mainstream media we thought we were home safe…”Free at last, free at last, Thank God Almighty we are free at last, we thought, to borrow a phrase from the late Dr. Martin Luther King Jr.






Twenty-six States who sued the Federal Government on behalf of their residents, and 150 million Americans received the shock of their lives last Thursday morning when the majority opinion was read by Chief Justice John Roberts siding with the four most liberal members of the Court, Ginsburg, Breyer, Kagan, and Sotomayor. It took me about two full days to recover from my shock and disbelief!

When George W. Bush nominated John Roberts to the Court we were told that he was such a great conservative jurist, and he would made an outstanding Chief Justice if he was confirmed. Well now we know the sad truth of the matter. And we learned it the hard way! Instead of an outstanding conservative jurist, Chief Justice John Roberts has expanded the power of Congress to tax us to death literally, on everything and nothing, all at the same time! It is now perfectly acceptable for Congress to tax us on literally nothing…our own inactivity! He leans more to the Left, than he does to the Right or the Center. His beliefs are more progressive than they are conservative or traditional. He takes a broader and more expansive view of the Federal Government’s role in our lives. He believes in a more powerful central government, not a limited constitutional government with enumerated powers. I guess john Roberts is the gift of George W. Bush that just keeps on giving, the legacy of George Bush that lasts for a lifetime!
